- Purpose of Policy
- The purpose of this policy is to establish clear guidelines for the acceptance, display, and deaccessioning of art and other objects at Decorah Public Library. This policy ensures that our library maintains its focus on its primary mission and manages its resources effectively.
- Display Priorities
- Decorah Public Library will install internally produced photos, displays, or graphics related to its current programs, mission, and strategic plan. The decision to display materials will be made by the library’s management team as part of their regular duties.
- Donations and Loans
- Decorah Public Library does not accept donations or temporary loans of art or other objects for display. This policy is due to limited space, resources for maintenance, and alignment with the library's primary mission and collection development strategy.
- Existing Objects
- Because storage space is limited, the library’s management team may digitize materials instead of retaining originals. Objects or materials that have enduring historical value to the mission of Decorah Public Library will be assessed by the management team and stored in conditions ideal for long-term preservation.
- Any existing art or objects within Decorah Public Library that lack provenance or clear historical documentation will be subject to review by the Library Board of Trustees. The Board will determine the appropriate course of action, which may include removal from display and deaccessioning from the library's collection.
- Deaccessioning Procedures
- If a decision is made to deaccession an item, Decorah Public Library staff shall:
- Ensure that the process is consistent with the library's mission and policies, as well as abiding by state and federal laws.
- Determine the most suitable method for disposition of the item, which may include transfer to another institution, sale, or disposal.
- If a decision is made to deaccession an item, Decorah Public Library staff shall:
- No Obligation to Display or Maintain
- Decorah Public Library has no obligation to display, maintain, or store any art or objects currently within its premises. Decisions regarding the retention or removal of existing items lacking provenance will be made at the discretion of the Library Board of Trustees.
- Conditional Gifts
- All donations and loans, if ever considered in exceptional cases, must be unconditional. The library reserves the right to determine the use, display, retention, and disposition of any item, without obligation to the donor.

- The position of any trustee shall be vacant if s/he moves permanently from the city, or if s/he is absent from six consecutive regular meetings of the board, except in the case of sickness or temporary absence from the city. Vacancies on the board shall be filled by appointment of the mayor, with approval of the council, and the new trustee shall fill out the unexpired term for which the appointment is made. Members may be reappointed.
- Trustees shall receive no compensation for their services.

- Article II. Officers
- On even years at the July meeting, the Board will elect a President, a Vice President, and a secretary for two-year terms.
- Article III. Duties
- The general powers and duties of the Board of Trustees include:
- To meet and elect from its members a president, a vice president, a secretary, and such other officers and committees as it deems necessary.
- To have charge, control, and supervision of the public library, its appurtenances, fixtures, and rooms containing the same, and to fix the rental rates of any property not immediately required for library purposes.
- To direct and control all affairs of the library.
- To employ a Director (Librarian) and Assistant Director, and authorize the librarian to employ such assistants and employees as may be necessary for the proper management of the library and fix their compensation; provided, however, that prior to such employment, the compensation of the librarian, assistant and employees shall have been fixed and approved by a majority of the members of the board voting in favor thereof.
- To remove by a two-thirds vote of the board the Director or Assistant Director and provide procedures for the removal of library assistants or employees for misdemeanor, incompetency or inattention to duty, subject however, to the provisions of Chapter 70, Code of Iowa.
- To select or authorize the librarian to select and make purchases of books, materials, furniture, fixtures, stationery and supplies for the library within budgetary limits set by the board.
- To authorize the use of the library by nonresidents of the city and to fix charges therefor.
- To make and adopt, amend, modify or repeal rules and regulations not inconsistent with ordinances and the law for the care, use, government and management of the library and the business of the board, fixing and enforcing penalties for violations.
- To have exclusive control of the expenditure of all funds allocated for library purposes by the council, and of all moneys available by gift or otherwise for the erection of library buildings, and of all other moneys belonging to the library, including fines and rentals collected, under the rules of the board.
- To accept gifts of real property, personal property, or mixed property, and devises and bequests, including trust funds; to take the title to said property in the name of the library; to execute deeds and bills of sale for the conveyance of said property; and to expend the funds received by them from such gifts, for the improvement of the library.
- To keep a record of its proceedings.
- To make and send to the City Clerk, on or before the deadline set by that office, an estimate of the amount necessary for the improvement, operation, and maintenance of the library for the coming fiscal year, the amounts expended for like purposes for the two preceding years and the amount of income expected for the next fiscal year from sources other than taxation.
- To cooperate with the Director of the Library in the development, adoption, and review of policies which govern the operation and programs of the library.
- To assist in the preparation of, and seeking adequate support for, the annual budget. The Board will participate with the Winneshiek County Library Association in the presentation to the Winneshiek County Board of Supervisors for support. It will also work with the City Clerk and the City Council in the presentation of a budget request to the City of Decorah. The Board approves monthly claims and monitors budget status.
- To develop long-range goals for the library and work toward their achievement.
- The general powers and duties of the Board of Trustees include:
- Article IV. Meetings
- The board will conduct monthly meetings on the second Monday of each month at 4:15 p.m. with both virtual and in-person options available for attendance. Board members may elect to attend in either manner (virtually or in-person) for any reason. In-person meetings will be held in the Public Meeting Room at the Library. Day and time for meetings will be determined annually at the July meeting to best for the schedules of board members.
- The Director of the Library and the President of the Board will consult on the preparation of the agenda, which is to be emailed five days prior to the regular meeting to all members of the board, posted in the library, and sent to City Hall for distribution to local media.
- Special meetings may be held at any time at the call of the President or Secretary or at the call of any two members of the Board, provided that notice thereof is given to all Trustees and to the public at least 24 hours in advance of the special meeting.
- A quorum at any meeting shall consist of five or more members. There is no provision for proxy voting.
- All meetings of the Board are open to members of the general public who wish to observe. Non-Board members who wish to address the Board should request a place on the agenda not later than 24 hours before the time established for the meeting. The request may be directed to the President, the Secretary, or the Librarian. The Board may go into closed session on matters expressly permitted by Iowa Law in Iowa Code 21.5.
- The meetings will be conducted under parliamentary procedures established by Robert’s Rules of Order.
- The President may appoint committees of one or more members for specific purposes as the business of the Board may require from time to time. The committee shall be considered discharged upon the completion of the purpose for which it was appointed and after the final report is made to the Board. A committee does not have other than advisory power.
- Article V. Director of the Library
- The Director of the Library shall be the executive director of the policies adopted by the Board. The Director shall be in attendance at all meetings of the Board and provide a monthly Librarian’s report at that time. Among the duties and responsibilities of the Librarian shall be:
- To select the library materials – books, magazines, newspapers, DVDs, audio recordings, electronic resources, etc.
- To maintain and operate the facilities;
- To recruit, train, assign, and dismiss members of the Library staff;
- To inform the Board continually and completely regarding the finances, public services, facilities, personnel, collection, and other developments, changes and problems concerning the library.
- The Director of the Library shall be the executive director of the policies adopted by the Board. The Director shall be in attendance at all meetings of the Board and provide a monthly Librarian’s report at that time. Among the duties and responsibilities of the Librarian shall be:

- Amendments to these Bylaws may be adopted at any regular meeting of the Board, provided that notice of proposed amendments be given to all members of the Board in advance of the meeting.

- Children’s Area Access Policy
- To ensure a safe and welcoming environment for our youngest library users and their families, the children's area of the Decorah Public Library is reserved for use by children, caregivers, and those using the children’s collection as intended.
- Policy Guidelines:
- Restricted Access: Adults (ages 18 and over) may only enter the children’s area when accompanied by a child, selecting or utilizing materials in the children’s collection, or assisting with a children’s program.
- Security Checks: Library staff may ask adults in the children's area to state the purpose of their visit and/or to leave the area at any time.
- Enforcement: This policy will be enforced by library staff to maintain the safety and comfort of children and families in the library. Non-compliance may result in being asked to leave the premises.
- We appreciate your cooperation in making the Decorah Public Library a safe space for all our library users.
- Meeting & Study Rooms
- The Decorah Public Library has meeting room spaces that support library programs and functions that further the goals of the library. When not in use by library or library affiliates, the rooms are available for use by the public. In accordance with the ALA Library Bill of Rights (paragraph six) and its interpretation pertaining to meeting rooms, the library makes meeting facilities available on an equitable basis. Use of the public meeting rooms does not imply endorsement, support, or sponsorship by Decorah Public Library of the activities that take place or the beliefs of the group using the area.

- The Meeting Room is available for educational, informational, or cultural meetings during the hours the library is open.
- Admission fees, donations, or other fees may not be charged or solicited. The meeting room is not available for fundraising, selling merchandise or services, soliciting for later sales, or placing orders. Fundraising events sponsored by the Library or Friends of the Library that benefit the library are exempt.
- The room may be rearranged as needed but must be returned to its original configuration and condition at the end of each meeting.
- Attendance must be recorded on the clipboard provided near the Meeting Room door.
- Groups are limited to two meeting room reservations per month.
- Guidelines for Study Room Use
- Study rooms are available for individuals or small groups.
- Admission fees, donations, or other fees may not be charged or solicited. Study rooms are not available for fundraising, selling merchandise or services, soliciting for later sales, or placing orders.
- Study room 1 is available for walk-in use and cannot be reserved in advance.
- Study Room 2 can be reserved for the current week beginning on Mondays at 9 AM
- Study rooms may be used for up to 2 hours/day/user or group.
- Conduct and Liability
- The Decorah Public Library Code of Conduct applies to use of the meeting room and study rooms.
- The Library Board and the City of Decorah or their employees or agents are not liable for any claims arising from the use of these facilities.
- Failure to abide by Library policies and procedures may result in denial of futural meeting room and study room requests.
- Statement of Purpose
Decorah Public Library is a community institution dedicated to fair and equal service for all. This Collection Development Policy provides guidelines for the library staff in their role as selectors of library materials. It also serves as a method of communicating to the public, the library’s funders, and other libraries, the connection between the community roles chosen by the library and the library’s collection.The primary purpose of the collection at Decorah Public Library is to fulfill the leisure, entertainment, and life-long learning needs of the citizens of Decorah and the greater Winneshiek County area. An additional area targeted for collection development is developing young readers by stimulating their thinking and communication skills. - Community Description
Decorah is located in the northeast corner of Iowa and is the county seat of Winneshiek County. The current population of Decorah is 7,587, and the population of the county is 20,262. The town is nestled in what is known as the Oneota Valley and located on the Upper Iowa River. According to the most recent census data, Decorah residents are younger (median age is 30.5 vs 41.5) and more educated than Winneshiek County residents (46.7% have at least a bachelor’s degree vs 30.6%), though the median household income is slightly lower ($62,366 vs $65,263.) Winneshiek County residents are younger, wealthier and more educated than the surrounding counties.An excellent public school system provides elementary schools, a middle school and a high school with enrollment of over 1,500 students. In addition, a parochial school, St. Benedict’s, offers a K-8 curriculum.Decorah is the home of Luther College, a four-year liberal arts college affiliated with the Evangelical Lutheran Church in America. Enrollment is around 1,700 students. The college employs over 700 faculty and staff members. Northeast Iowa Community College is located 10 miles south of Decorah.Agriculture and manufacturing continue to be key components to the local economy. Tourism also plays a big role in the local economy with out-of-town guests visiting the local breweries, outdoor and natural resources, and arts and cultural organizations. A lively downtown business district contains many specialty stores. Decorah is also home to Vesterheim Norwegian-American Museum, Porter House Museum, and Seed Savers Exchange.

- Materials Selection Criteria and Procedures
- Materials Selection
The selection of materials includes the decision to add and/or retain materials in the library’s collection. All library acquisitions, whether purchased or donated, are considered and evaluated using the same standards. Library staff select material using the following criteria.
Materials selection criteria may include:- demonstrated or perceived interest, need, or demand by library users or potential users, including library user requests
- contemporary significance or popular interest
- representation of the experiences and contributions of diverse populations
- quality, including accuracy, clarity, and usability (this applies primarily to nonfiction selections)
- review sources, including but not limited to:
- Baker & Taylor publications
- Book Page
- Library Journal
- New York Times Book Review
- Publishers Weekly
- significance and/or reputation of the author and/or other contributors
- importance as a document of the times
- relation to the existing collection
- format, durability, and ease of use
- value of resource in relation to its cost
- The library acquires materials in a variety of formats, including books (hardcover and paperback), e-books, digital audiobooks, digital films, books on CD, electronic databases and networks, newspapers, magazines, and DVDs. In some circumstances, the same work may be acquired in more than one format. Popular titles are often purchased as multiple copies to meet library user demand.
- Evaluation, Weeding and Withdrawal
In order to maintain current reading, viewing, and listening materials, the library continuously reviews its collection and removes materials that are worn, obsolete, or have not circulated over a three-year period. Library staff use the “C.R.E.W. Method” developed by the Texas State Library to evaluate the collection for weeding and withdrawal.When items are withdrawn from the collection, library staff will consider replacing popular volumes that have been withdrawn due to wear. Library staff will determine if outdated materials should be replaced with new information in order to maintain a balanced collection. Library staff are responsible for ensuring that the withdrawal process is not a form of censorship.Materials that meet the above criteria will be labeled as “withdrawn” and will be recycled.
- Gifts
Decorah Public Library welcomes gifts of new and used books (published within the last year), books on CD, and DVDs. Items will be added to the collection in accordance with the materials selection policies. Once donated, the items become the property of Decorah Public Library and may be given to other libraries or governmental agencies, sold, traded or discarded if they are not added to the collection. Donated items will not be returned to the donor and the library will not accept any item that is not an outright gift. The library will acknowledge receipt of the items but is unable to set fair market or appraisal values. It is recommended that the donor make a list of items donated. If items are being donated to obtain a tax benefit, it is the donor’s responsibility to establish fair market value. The library also reserves the right to decide when a gift added to the collection must be withdrawn according to the evaluation and weeding processes outlined above.Monetary gifts, bequests and memorial or honorary contributions are particularly welcome. Funds donated for the purpose of collection development will be used to purchase items in accordance with the selection policies of Decorah Public Library. Books, DVDs, and other materials purchased with bequests or memorial or honorary contributions will be identified with special donor plates whenever possible. If requested, notification of memorial or honorary contributions will be sent to the family of the person being recognized. Suggestions for subject areas or other areas of interest are welcome and will be followed to the extent possible. - Materials Reconsideration
The library welcomes expressions of public opinion concerning materials selected or not selected for inclusion in the collection. Requests to add or remove library materials will be considered within the context of the principles affirmed in this document.Library users or staff members who wish to request the reconsideration of library materials must complete and sign a “Request for Reconsideration” form, which is available at the library’s front desk. Anonymous phone calls, rumors, or voiced concern will not be honored – action will only occur after the completed and signed “Request for Reconsideration” form is returned to the library.Once a completed “Request for Reconsideration” form is returned to the library, the Library Board is notified and a formal investigation begins. During this process, the material in question remains in the library’s collection.- The Library Director will discuss the Request for Reconsideration with the staff member who is responsible for that part of the collection.
- The Library Director reviews both the Request for Reconsideration and the perspective provided by staff.
- The Director submits their written recommendation to the Board.

- Purpose
- The purpose of this policy is to affirm the library's role in providing public access to the Internet and to clarify library user responsibilities associated with Internet use in the library.
- Internet use in the library means using the library's network to access the Internet either on library workstations or through a wireless connection.
- Principles
- Public access to the Internet is integral to the Decorah Public Library's mission of providing materials and programs for the leisure, entertainment and the life-long learning of the citizens of Decorah and the Winneshiek County area.
- Decorah Public Library provides public access to the Internet in accordance with state and federal laws and the policies of the Decorah Public Library Board.
- The Library does not retain browser history or personal information. The library does maintain a log of date, time and duration of library user access to public computers for administrative purposes. The library will not share information regarding access unless required by law or court order.
- Scope of Access
- Public access to the Internet is available via library workstations and wireless access. Filtering software is used to filter out proxy sites, and sites that pose a security risk to the network. It is also used to filter out obscene materials as defined by The Children’s Internet Protection Act (CIPA). Filtering is not intended to block access to material protected by a library user’s First Amendment Rights. If it is determined a legitimate website has been blocked it should be reported to the
- Technology Coordinator. The Technology Coordinator will work with the network administrator to unblock the website with minimal delay and respect for user privacy.
- Library workstations support a variety of software programs that expand a workstation's capabilities and increase a library user's ability to utilize the Internet. Installation of software by library users is prohibited.
- The library may establish time limitations to ensure fair and equitable access to library workstations.
- Library staff may provide guidance for accessing library materials and services, general internet navigation, printing, and basic technical support. Technology assistance requiring extended explanations, basic skills training or device specific assistance may be available, time permitting, and must be scheduled in advance with the Technology Coordinator. Library staff are prohibited from entering personal information, such as financial, transactional, legal, or medical data, on computers for library users.
- The Decorah Public Library Board, City of Decorah, Decorah Public Library, and its employees assume no responsibility for damages of any type arising from library user use of the Internet through the library's network.
- Library user Responsibilities:
- Library users acknowledge that the content on the Internet is not managed or governed by any entity and therefore they may encounter materials that are inaccurate or that they consider offensive.
- Library users recognize that their use of the Internet is conducted in a public place shared by many. Library users are subject to the Decorah Public Library Rules of Conduct Policy.
- Library users acknowledge that security for personal devices rests solely with the owner.
- Library users acknowledge that the library cannot protect the privacy of data that is transmitted to third parties via the Internet.
- Library users shall comply with all federal, state, and local laws including but not limited to:
- Library users may not use the library's Internet access to view, print, distribute, display, send or receive images, or graphics of material that violates laws relating to child pornography
- Library users may not knowingly exhibit or display any material which is harmful to minors in its content or material that is obscene in any place of public accommodation where minors are or may be present and where minors are able to view the material
- Library users must adhere to all copyright laws and may not copy or distribute materials (e.g. with the use of file sharing software) without the permission of the owner. Library users who do so may be subject to criminal and civil liability.
- Failure to follow this policy may result in disciplinary action in accordance with the Library’s Rule of Conduct Policy. Violation of state and federal laws will be referred to the proper authorities for legal action.
- Parent and Guardian Responsibility
- Monitoring and any restriction of a child’s access to the internet is the responsibility of the parent or legal guardian.

- Items may be renewed twice unless on reserve. Renewals may be done online, by phone, or in person. Any item on reserve for another library user will not be renewed.
- Reserves:
- Items in the library catalog may be placed on reserve. When reserved materials become available, they are immediately checked out to the library user’s account and that person is then notified by email, text, or phone call. Materials are placed on an accessible shelf for users to collect at their convenience.
- Overdue fines:
- The Library Board approved going fine-free on January 10, 2022.
- Lost and/or Damaged Items:
- Overdue notices will be sent via text or email when materials reach 7 days overdue, and a second notice will be sent when an item is 14 days overdue.
- When items are 28 days overdue, library users will be notified that the item has been marked as ‘lost’ and their account will be blocked from further checkouts (including digital checkouts on Libby) until overdue items are returned or the replacement fee for the item has been paid.
- Library users are expected to pay the list price of the lost or damaged item. Refunds may be made for paid items that are later found and returned.
- Warning letters and Municipal Infractions may be issued for the replacement cost of lost or damaged materials.

- A limited number of standard office supply items including pens, pencils, staplers, tape, white out and scissors are available for library users.
- Meeting Rooms
- Emergency Procedures:
- Emergency announcements will be made over the library’s public address system.
- Closure of the library will be at the discretion of the Director or staff person in charge
- All building occupants should follow the directions given by staff
- Fire:
- Become familiar with the location of fire exits when using the library
- Evacuate the building if you hear the fire alarm and/or public address announcement
- Follow any other instructions given by library staff
- Library users will not be allowed to re-enter the building until the all-clear has been given by Decorah Fire Department
- Severe Storm/Tornado Warning:
- When a severe storm warning has been issued and/or the tornado siren has gone off, staff will make an announcement on the library’s public address system
- Library users should go to the Public Meeting Room in the lower level of the building
- An all-clear announcement will be made via the public address system once the warning has expired
- Winter Weather:
- The library may open late, close early, or close for the day when winter weather creates dangerous conditions. Examples of this include ice storms, blizzard warnings, or extreme cold. The safety of staff and library users will be the primary factor when determining building closures.
- Closing announcements will be posted on exterior doors and local media outlets will be notified.

- Overview
- The Decorah Public Library is responsible for enforcing rules of conduct to protect the rights and safety of library users, visitors, volunteers, and staff. The rules are also to preserve and protect the library’s materials, equipment/furniture, facilities, and grounds. In addition, the library has a strong commitment to intellectual freedom and to freedom of access to information.
- Library users are expected to:
- Comply with the law
- Follow instructions from library staff
- Use the library space safely
- Consider other library users and staff
- Share community resources
- The Rules of Conduct prohibits library user behavior that:
- Interferes with the rights of individuals to use library materials and services
- Interferes with the ability of library staff to conduct library business
- Threatens the secure and comfortable environment of the library
- Enforcement
- Enforcement of the rules will be conducted in a fair and reasonable manner and in accordance with local, state, and federal regulations. Library staff and/or local law enforcement will intervene to stop behaviors that violate this policy. Failure to comply with the library’s established rules, regulations, and policies could result in a ban from the library, or in arrest and prosecution. Violations could also result in the restriction and/or termination of library privileges, including the use of library computers or equipment. Library users should consult with library staff if another person’s behavior disrupts their use of the library.
- Repetitive disruptive behaviors that may result in a one day to one week ban from Decorah Public Library may include, but are not limited to:
- Shouting, swearing.
- Running and roughhousing.
- Interfering with others’ use of the library: blocking free passage, using the elevator repeatedly as entertainment, soliciting, excessive noise-making, or poor personal hygiene.
- Bringing bicycles into the library. Wheelchairs, walkers, and strollers are permitted.
- Using skateboards, rollerblades, wheeled shoes, or scooters on library property.
- Bringing comfort, emotional support, or any other non-service animal (as defined by the American Disability Act) into the library.
- First incident of violating library policies on Internet use.
- Engaging in loud or disruptive phone conversations.
- Eating food or drinking uncovered beverages in the library.
- Sleeping or snoring.
- Interference with others’ use of the library through poor bodily hygiene which is so offensive as to constitute a nuisance or through excessive use of perfume, cologne or other scented products.
- Failure to wear protective footwear.
- Behaviors that are illegal or violate library guidelines will result in a one to six month banning depending on severity of infraction and may include, but are not limited to:
- Defacing, damaging, destroying, or stealing library property or the property of others.
- Making threats against or abuse of library users or staff. This includes verbal abuse and nonverbal intimidation or harassment including, but not limited to, stalking or staring; online, cell phone, or computer harassment; language that is obscene or sexually harassing; or language that violates Library’s policy against violence, discrimination, harassment, or offensive behavior.
- Aggressive behavior toward library users or staff.
- Assault of library users or staff including but not limited to, grabbing, spitting, or hitting.
- Brandishing a weapon.
- Performing obscene acts in the library or on library property.
- Consuming or being under the influence of alcoholic beverages or controlled substances that causes a public disturbance or antisocial behaviors.
- Use of tobacco products (including vaping) is forbidden throughout the library, including meeting rooms and vestibules and within 20 feet of the public library property.
- Failure to adhere to the Decorah Public Library Policy on the Internet or Internet Usage Guidelines. This includes repeat offenses, extending time limits, and/or using another’s library card.
- Failure to observe banning restrictions or multiple violations.
- Additionally:
- The Library Director or designee may supersede conduct policy guidelines at their discretion.
- Library users warned or asked to leave the library will be given a copy of the Rules of Conduct policy.
- Returning after a ban: banned library users must make arrangements with the Director before returning to the library. If the user is under 18, they must make arrangements with the Children’s and Young Adult Librarian before returning to the library. Library users will be notified of their potential return date at the time of the ban.
- Overview
- The responsibility for the safety and behavior of children in the library rests with the parent/caregiver and not with the library staff.
- Children under 8
- Children under the age of 8 must be accompanied and closely supervised at all times by a responsible caregiver (14 years or older) when using library collections, services, or programs (unless otherwise noted in program registration materials).
- Children over 8
- Children ages 8 and older may use the library independently. The Library Rules of Conduct apply to library users of all ages. Parents/caregivers are still responsible for the behavior of their children even if parents/caregivers are not present. If a child becomes anxious or disruptive the staff will attempt to find the parent or caregiver in the library. If they are not available, staff will call the phone number listed on the child’s library account. It is the responsibility of the parent or caregiver to be accessible to pick up the child at any time. If a child of this age group is not able to leave the library without an adult, they should not be in the library alone. Children must also have the phone number of a parent/caregiver that may be contacted in an emergency.
- Unattended Children After Closing Time
- The library is not responsible for children without a ride home at closing. Parents/caregivers are responsible for being aware of the library’s hours of operation. Parents/caregivers must also keep in mind that the library may close unexpectedly for reasons out of the control of staff, such as a power outage, loss of heat, inclement weather etc. Children should know what to do should this occur. Library staff cannot give rides to any child.
- If no ride has arrived within 15 minutes after closing time the staff will call the Decorah Police Department. Two Library staff members will wait for the Police with the child.
- Staff will record the parent’s/caregiver’s name, address, telephone number, and the child’s name.
- Once found, the parent/caregiver will be given a copy of the Safe Child Policy.
- Staff will refer any additional incidents to the Police Department.
- The library is not responsible for children without a ride home at closing. Parents/caregivers are responsible for being aware of the library’s hours of operation. - Privacy and Confidentiality
- Camera placement shall be determined by the Library Director or their designee. Cameras shall not be placed in areas where there is a reasonable expectation of privacy, such as restrooms.
- To the extent that any recorded images include identifiable persons requesting information or checking out an item, such record shall be treated as confidential as provided in Iowa Code §22.7 (13). Any inadvertent views of protected information shall be held in confidence by the library staff under the library’s Intellectual Freedom Policy.
- Public Notice
- Signage shall be displayed within the library advising of the recording of video images. Conversations or other audible communication shall not be monitored or recorded by the security cameras.
- Data Storage
- Cameras will record activities in real time and images will be saved to the camera server. The capacity of the storage system allows for images to be stored for at least 14 days. The library is not obligated to store images past the 14-day limit.
- Cameras will not be monitored continuously by library staff. Authorization to view stored images may be granted by the Library Director or their designee(s).
- Authority and Access to Recorded Data
- The Library Director holds the authority to designate library staff members who may access video in real time or recorded formats.
- Circumstances under which designated staff may access images in real time include, but are not limited to, observation of areas beyond view from designated work stations for assurance of safety and security. Access to real time or recorded imagery is also authorized to designated staff upon report of suspicious behavior, including policy violations, criminal activity, destruction or theft of library property or assets, or other activity that may be disruptive to library operations.
- Law Enforcement
- All requests for the viewing of real time or recorded imagery by law enforcement officials must be presented to the Library Director. If the Library Director is unavailable, such requests shall be presented to the Assistant Director or Technology Coordinator. Law enforcement may view recorded images unless such images include records protected by Iowa Code §22.7 (13), in which case such records would be released only pursuant to valid court order.
- Public Disclosure
- All requests for public disclosure of recorded images shall be presented to the Library Director. If the Library Director is unavailable, such requests shall be presented to the Assistant Director or Technology Coordinator. Disclosure of video imagery shall be evaluated and processed in accordance with Iowa Code Chapter 22.

- The following text in quote is taken from the Code of Iowa.
- 7 (13) Confidential records.
- The following public records shall be kept confidential, unless otherwise ordered by a court, by the lawful custodian of the records, or by another person duly authorized to release such information:
- The records of a library which, by themselves or when examined with other public records, would reveal the identity of the library patron checking out or requesting an item or information from the library. The records shall be released to a criminal or juvenile justice agency only pursuant to an investigation of a particular person or organization suspected of committing a known crime. The records shall be released only upon a judicial determination that a rational connection exists between the requested release of information and a legitimate end and that the need for the information is cogent and compelling."
- Chapter 13 pertains specifically to Libraries. The remainder of Iowa Code section 22.7 pertaining to confidential records must also be taken into consideration when releasing records which is mentioned in the Public Disclosure section of this policy.
- Iowa Legal Code
- Iowa Code Section 692A.113 prohibits a sex offender who has been convicted of a sex offense against a minor from being present upon public library real property without the written permission of the library director, or from loitering within 300 feet of the boundary of the real property of a public library.
- A “sex offender” is someone who is required under Chapter 692A to be on the Sex Offender Registry.
- "Sex offense against a minor" means an offense for which a conviction has been entered for a sex offense classified as a tier I, tier II, or tier III offense under Chapter 692 if such offense was committed against a minor, or otherwise involves a minor.
- “Loiter” means remaining in a place or circulating around a place under circumstances where a reasonable person would believe that the purpose or effect of the behavior is to enable a sex offender against a minor to become familiar with a location where a potential victim may be found, or to satisfy an unlawful sexual desire, or to locate, lure, or harass a potential victim.
- In addition, the law prohibits a sex offender who has been convicted of a sex offense against a minor from being employed by or from acting as a contractor or volunteer at any public library.
- Iowa Code Section 692A.113 prohibits a sex offender who has been convicted of a sex offense against a minor from being present upon public library real property without the written permission of the library director, or from loitering within 300 feet of the boundary of the real property of a public library.
- Exceptions
- There are two exceptions to this law. A sex offender who has been convicted of a sex offense against a minor may be present: 1) during the period of time reasonably necessary to transport the offender’s own minor child or ward to or from the library; and 2) during the period of time reasonably necessary to vote in a public election if the polling place is located in the library.
- Other exceptions to this policy can occur only with written permission of the Library Director. The Library Director will determine eligibility to be on Library property and may consult with law enforcement, social service agencies, and/or other appropriate governmental officials. The Board of Trustees will not entertain any appeals of the Director’s determination.
- Access to Materials
- If a request for permission to be on Library property is denied, an offender may arrange for a third party to select, check-out and return materials to the Library on their behalf. The Library may issue a borrower’s card in the offender’s name to be used by the third party.
- Enforcement
- The responsibility for compliance with this law rests with the offender. However, if Library staff has knowledge or receives information, that a person who has been convicted of a sex offense against a minor is on library premises, the Decorah Police Department will be contacted.
- Volunteers and applicants for employment will be screened as appropriate for compliance with the law.
The Decorah Public Library Board of Trustees and staff are responsible for providing equitable access to library materials and services for all library users. Materials and programs are chosen with the diverse needs of the community in mind. Selections are based on need, the current content of the collection and/or programming schedule, recommendations/requests, and professional review sources or current trends. The Library's role is to provide opportunities that will allow individuals to freely examine subjects and make their own decisions. This form is authorized by the Decorah Public Library Board of Trustees for use by any library user who wishes to express concerns regarding library materials or programs. If you have a concern, please complete this form and return it to the Library Director. The Director will present it to the Board of Trustees at the next regularly scheduled meeting. The Library Board Chair will respond in writing to the library user within 30 days of the Board meeting where the concern was discussed.
